The law defines a “major rule” as one that costs $1,000,000 or more in its first five years. LOFT must review proposed rules, do independent economic analyses for major rules, and post results online. Within 21 days of receiving a rule, LOFT checks if the agency followed required steps and if costs top $1,000,000. LOFT sends a report to the designated committee chairs by day 21 and flags missing or inaccurate impact statements. Chairs may ask LOFT to review a nonmajor rule they think is actually major, agencies must give LOFT needed data, and LOFT issues an annual report that quantifies savings and other impacts.
Agencies must allow at least 30 days for public comment after notice. If ten people, a political subdivision, an agency, or a 25‑member association asks within 30 days, the agency must hold a hearing, and it cannot be earlier than 30 days after notice. For legislative review, rules received by February 1 are reviewed through the end of session; for the 2nd Session of the 59th Legislature the deadline is March 1, then February 1 thereafter. Joint resolutions on major rules must contain only those major‑rule actions, with no unrelated subjects. The act declares an emergency and also sets July 1, 2025 as the statutory effective date.
Emergency rules need an impact statement showing if the rule is major and its costs. Agencies prepare it before adoption unless the Governor waives that step; if waived, they file it within 45 days. After adoption, agencies send the rule and statement within 10 days to the Governor and other listed offices. The Governor has 45 days to review the emergency claim and the rule, must get a formatting check by the Secretary of State, and may approve only if the rule is clear, within authority, and follows the Administrative Procedures Act. When giving notice of any proposed rule, agencies must also send it to the Governor and cabinet secretary; written disapproval within 30 days blocks adoption.
