Courts stop deferring to state agencies

Beginning November 1, 2025, courts and hearing officers read statutes and rules on their own, without deferring to a state agency’s view. They use normal tools of interpretation. If doubt remains, they favor a reasonable reading that limits agency power and protects individual liberty.

Jury trial needed before agency penalties

Beginning November 1, 2025, an agency cannot get a civil penalty for conduct that would entitle you to a jury at common law unless a jury in a constitutional state court awards it. This rule does not change summary‑judgment practice under Title 12. It does not apply to equity cases that historically had no jury right.

New deadlines and simpler agency appeals

Beginning November 1, 2025, you must file for court review within 30 days after notice of the final agency order. File in the district court where you live, or where the affected property is. Serve the agency and all parties of record, and file proof of service within 10 days. A claim accrues when any properly joined plaintiff can sue, starting at the date the party is aggrieved by final agency action. You do not need a motion for new trial or a rehearing first. Parties not named may respond within 10 days, and courts may allow others to intervene. If a court finds a proceeding is frivolous or brought to delay, it can shift costs and reasonable attorney fees.
