Beginning November 1, 2025, eminent domain cannot be used to build certain renewable facilities on private land. It covers wind, solar, battery storage, hydrogen, and other renewable energy facilities. This protects landowners from having their land taken for those projects.
Beginning November 1, 2025, companies that furnish electricity or natural gas in Oklahoma can use eminent domain like railroads. They must be organized in, or authorized to do business in, the state. This authority is still subject to the limits in this law.
Starting November 1, 2025, companies must get a Certificate of Authority before using eminent domain for lines over 300 kilovolts. The Oklahoma Corporation Commission issues the certificate. Retail electric suppliers and rural electric co-ops do not need it for extensions, rebuilds, or upgrades.
