The law lets some green hydrogen projects provide power without becoming a public utility. They can serve only themselves, an affiliate, or tenants on the same site that make green hydrogen. They can also hire a utility, co-op, or city to deliver power to a named customer, or be an exempt wholesale generator. They cannot resell power at retail or provide it to the public. They must follow all grid interconnection and registration rules and pay those costs. Their power setup must include a natural gas part. Public utilities do not have to serve these customers.
