Bill Overview

Analyzed Economic Effects

7 provisions identified: 4 benefits, 2 costs, 1 mixed.

School rules and limits on NIL deals

You cannot use school trademarks or logos in a paid deal unless the school approves. The school may set reasonable time, place, and manner rules and may charge for use of school marks or facilities tied to NIL events. You cannot sign deals that conflict with written school policy or that harm the school’s reputation. Contracts you sign while playing generally cannot run past your college eligibility, unless the deal is with your school or its authorized partner; the school can keep using content if the agreement allows. If you take a payment that this law or the governing association does not allow, the school can revoke scholarships or other payments, without liability.

Athletes can earn NIL and hire agents

Student athletes at Oklahoma colleges can be paid for use of their name, image, and likeness while enrolled. Hiring a professional agent to help with NIL deals is allowed and does not affect your right to play or your athletic grant-in-aid. Getting NIL pay or being on a team does not by itself make you an employee of the school or an athletic association.

Colleges can help arrange NIL deals

Your college or an authorized third party can help find, set up, or support NIL opportunities, and can arrange or direct payments when allowed by association and school rules. Athletic associations cannot stop schools from working with outside providers to support NIL. Colleges or authorized agents may also sign exclusive or nonexclusive licenses or endorsements using student-athlete NIL for school promotion.

No extra releases for game broadcasts

Players and spectators at sports events do not need to sign a separate NIL release to be filmed, recorded, or broadcast. Event coverage can occur without extra agreements.

Schools may require NIL training

Your college can require classes or training on contracts, financial literacy, or similar topics to prepare you for NIL deals. This education aims to help you manage agreements and money before you play.

No state money for NIL payments

Oklahoma public colleges cannot use state-allocated funds to pay student athletes for NIL. Any such payments must come from non-state sources.

Fast NIL disclosures and written contracts

NIL or representation contracts must be in writing, signed by both sides, and list duties and fees. You must tell your school about any NIL or representation contract within 72 hours of signing or before your next eligible game, whichever comes first, using the school’s method. Anyone you hire to represent you must make sure you make this disclosure.
