Beginning November 1, 2025, you can pay cash for a covered, medically necessary service at a price you negotiate below your plan’s average allowed amount. You must send your insurer proof of the service and provider, any required order, the agreed price and the provider’s promise not to bill the plan, and the final bill if you have it. Your insurer then counts the full amount you paid toward your deductible and annual out-of-pocket max. Credits go to the in-network or out-of-network totals based on the provider’s network status. Providers must accept your payment as payment in full and cannot balance bill you or your plan. Credits only apply within your plan’s contract period and do not carry over to a new period.
Beginning November 1, 2025, the law defines which plans, providers, and services these rules cover. Covered plans include individual and group medical insurance, HMOs, PPOs, the Oklahoma Employees Insurance Plan, and some employer welfare plans. It does not apply to Medicaid‑contracted plans, Medicare supplement policies, workers’ compensation, motor‑vehicle medical payments, long‑term care, short‑term policies of six months or less, accident‑only, or limited dental or vision plans. A health care service includes diagnosis, prevention, treatment, mental health and substance use care, and durable medical equipment, but not giving or prescribing drugs. These definitions decide if your plan and service qualify for the cash‑price and deductible‑credit rules.
