New state unit to fight fake IDs

The Department of Public Safety sets up a Fraudulent Documents Identification Unit. It investigates and helps arrest people and businesses that make or sell fake IDs, including IDs made for people unlawfully in the state. The department hires enough staff if funding is available.

Undercover licenses allowed for investigations

The Department of Public Safety can approve a license that would otherwise be illegal to help a criminal investigation or a military or intelligence operation. Only the chief of a law enforcement, military, or intelligence agency can request it. People acting within that approval are not prosecuted for covered violations. The license must be returned when the approval ends.

License finger scans required, with privacy limits

You must give an inkless finger scan to get a new, renewed, or replacement Oklahoma license or ID. If you are 65 or older and cannot be scanned, an agent may verify your identity and approve an override, which is logged. For unemancipated minors under 18, a parent or guardian must sign a form or submit a notarized affidavit before scanning and issuance. Only Service Oklahoma and the Department of Public Safety can access finger-scan images without a court order. Other law enforcement must get a judge’s written order showing probable cause naming a person and a specific crime. The Oklahoma State Bureau of Investigation may use images without a court order only to identify deceased, missing, or endangered people.
