Death or life terms for repeat child predators

Beginning November 1, 2025, a person convicted again of certain sex crimes against a child under 14 can be punished by death or life without parole. This applies to repeat convictions for rape, rape by instrumentation, forcible oral or anal sodomy, or lewd molestation.

Harsher penalties for lewd acts with minors

Beginning November 1, 2025, lewd proposals or touching of a child under 16 carry 3 to 20 years in prison. If the child is under 12, the minimum is 10 years and life is possible. This rule applies when the accused is at least three years older, unless force or fear is used. A second conviction blocks probation, suspended, or deferred sentences, and a third can bring life or life without parole. Sentences of two years or more require post‑prison supervision, and police undercover help is not a defense.

Stronger punishments for child sexual abuse

Beginning November 1, 2025, sexual abuse or sexual exploitation of a child is a felony. Penalties include prison up to life, county jail up to one year, and a $500 to $5,000 fine. If the prison term is two years or more (not life terms), the person must also serve post‑prison supervision. If the child is under 12, the minimum prison term is 25 years. The law says a child’s consent is not a defense and protects anyone under 18.

Tougher penalties for child abuse by caregivers

Beginning November 1, 2025, willful or malicious child abuse or neglect is a felony. A caregiver who abuses, neglects, or enables it can face prison up to life, county jail up to one year, and a $500 to $5,000 fine. The law defines who counts as responsible for a child and what acts are abuse or neglect. It also keeps the parent right to use “reasonable and ordinary” force for discipline under Section 844.

Felony sexual battery and corpse abuse ban

Beginning November 1, 2025, sexual battery is a felony when someone 16 or older is touched in a lewd way by certain school or state‑custody employees or others in supervisory roles. A conviction can mean up to 10 years in prison. The law also bans lewd acts involving a human corpse, with up to 10 years in prison.
