Broader rape definition and protections

Beginning November 1, 2025, Oklahoma updates what counts as rape. It covers intercourse with anyone under 16. It covers people who cannot legally consent because of mental illness, or who are unconscious. It covers force or credible threats, and cases where the accused gave drugs to force submission. It also covers tricking someone into believing the actor is their spouse, including when a spouse helps. The rules apply inside or outside marriage and regardless of sex.

Law takes effect November 1, 2025

Beginning November 1, 2025, all changes in this act apply. Courts and law enforcement use the new definitions and rules on that date.

Stronger protections in custody and foster care

Beginning November 1, 2025, sex with people in custody or foster care is rape in more cases. It is rape when a person in legal custody or supervision has sex with an agency employee, contractor, or subcontractor who has authority over them. It is also rape when a foster parent or foster parent applicant has sex with a ward who is 19 or younger and in state, federal, or tribal custody.

Student protections from school and college staff

Beginning November 1, 2025, students get stronger protections from school and college staff. It is rape when a 16- to 19-year-old student, or a student under school supervision, has sex with an adult employee, contractor, or subcontractor of the school. It is also rape when a high school student who is taking college classes has sex with an employee of that college. "Employee" includes faculty, instructors, volunteers, and contractors who can use institutional authority. It does not include a student worker or volunteer who is no more than three years older than the high school student.
