Fines for below-cost sales; fuel higher

Beginning November 1, 2025, advertising, offering, or selling below the law's cost is a misdemeanor. Retailers and wholesalers can be fined up to $500 per violation. For motor fuel, the fine can be up to $1,000. These rules cover retail and wholesale sales and offers.

How sellers must compute legal cost

Beginning November 1, 2025, sellers must use a set formula to find "cost." Use the lower of the invoice price or a 30-day replacement price for the same quantity, minus trade discounts. Then add freight, cartage (0.75% default unless you prove less), and any state and federal taxes. Retailers must also add a 6% markup by default unless they prove a lower amount. If items are bundled or given as a gift with purchase, each item must meet the rule on its own.

Which sales and businesses are covered

Beginning November 1, 2025, the law clarifies who is covered. A retailer sells to people who will use the item; a wholesaler sells for resale or further processing. Keeping title as security still counts as a sale. If a business does both, the retail rules apply to retail activity and the wholesale rules apply to wholesale activity.
