Protects foster and adoptive parents' beliefs

Beginning November 1, 2025, DHS cannot require parents to affirm or support policies on sexual orientation or gender identity that conflict with their sincere religious or moral beliefs to be eligible. DHS cannot deny needed authorization to adopt or foster because of those beliefs. DHS also cannot use those beliefs to stop a parent from being considered for a specific placement.

Child and family beliefs guide placements

Beginning November 1, 2025, DHS may consider a child’s or birth family’s religious or moral beliefs, including views on sexual orientation and gender identity, when choosing the best placement. DHS can compare those beliefs with a prospective parent’s beliefs to decide what is in the child’s best interest. This can affect which parents are matched with a child. The law keeps DHS’s duty to put the child’s best interests first.
