Beginning July 1, 2025, it is a crime to knowingly photograph someone who has a reasonable expectation of privacy without consent, or without a minor’s parent or guardian’s consent. The law covers photos taken for the photographer’s sexual arousal. It also covers photos that show unclothed intimate areas or sexual activity when the photographer knew it. It includes photos focused on intimate areas that would offend or embarrass a reasonable person and were taken for sexual arousal. A person can have privacy even in public if the shot shows body parts not normally visible and was taken in an offensive way.
Beginning July 1, 2025, judges must order anyone convicted under § 39-13-605(a)(1) or (a)(3) to register as a sexual offender, in addition to any other punishment. The registry law also lists those unlawful photography crimes as registrable for acts on or after July 1, 2025.
Beginning July 1, 2025, violating § 39-13-605(a)(1) or (a)(3) is a Class E felony. The crime becomes a Class D felony if the offender used a child under 13 to help do it. It becomes a Class C felony if the victim was under 13, or the offender used a position of trust or power to accomplish it.
