Starting October 1, 2026, providers may not knowingly ask minors the listed gender-identity or dysphoria questions. A provider can ask only if a parent is fully informed and gives written consent, and the question is directly tied to current diagnosis or treatment. Intake forms and electronic questionnaires for minors must leave out these items unless those two rules are met. Providers may ask if the minor volunteers the information, or in private when they reasonably suspect trafficking, abuse, or neglect to check mandatory reporting. These rules do not apply when a minor receives care without parental consent under Tennessee law. Parents must be allowed to see all forms and electronic assessments given to their child. Abuse-reporting and emergency-care duties stay the same, and minors can still report safety concerns. Violations are unprofessional conduct and can lead to board discipline.
Starting October 1, 2026, insurers and managed care groups cannot require or request providers to ask minors certain gender-identity or dysphoria questions. They also cannot cut or deny payment or penalize providers for not asking. Questions about a female’s menstrual period are still allowed. A "minor" is under 18, but not an emancipated youth, someone getting emergency care, a current or former service member, or a custodial parent of a child.
