New filing, steep fines for foreign farmland owners

Beginning July 1, 2025, foreign persons who must file an AFIDA report with USDA must also file a copy with Tennessee’s Commissioner of Agriculture, within the same federal deadline. If the copy is not filed, the Attorney General may seek a civil penalty up to 25% of the fair market value of the land interest on the penalty date. The state may sue in the circuit court of any county where any part of the land is located. This applies to AFIDA reports to USDA on or after July 1, 2025.

Rules and sunset for foreign land filings

The Commissioner of Agriculture can issue rules to carry out this law, following Tennessee’s Uniform Administrative Procedures Act. If the federal AFIDA law is repealed, this Tennessee reporting section ends. The Commissioner must notify the Tennessee Code Commission in writing when that repeal occurs.
