The law keeps your agricultural, forest, or open-space land qualified after a death or divorce. This applies only if exactly two individuals own the land and the title is tenancy by the entireties or joint tenancy with a right of survivorship. If one owner dies and the survivor keeps the property by survivorship, ownership counts as unchanged and the land stays qualified. If the owners divorce and one keeps the land through the court’s division, ownership also counts as unchanged. This rule is in effect now.
