Beginning July 1, 2026, counties, cities, and metropolitan governments must keep written records for any development fee over $250. The record must explain why the fee is charged and its cost basis. They create or update it when a new fee starts or when an existing fee increase is more than $250. They keep the record on file, make it public for inspection, and the Comptroller audits it each year. The record is made once per fee or change, not each time the fee is charged.
Beginning July 1, 2026, connection costs for utilities covered by state utility law use Title 65, Chapter 5, Part 4. Those utilities, not local governments, must keep and provide documentation under that law. This exception applies to utility hookup and connection charges.
