Beginning July 1, 2025, providers must give records electronically if they normally keep them that way. When you or your personal representative ask for your own electronic records, charges are limited to actual labor, supplies (including media), and postage. Electronic radiology images are capped at $25 for a CD/DVD/USB or $15 if emailed or sent through a portal.
Beginning July 1, 2025, paper medical record fees are capped. You pay $25 for up to five pages, then $0.50 per page after five. Printed radiology films can cost up to $20 each. Providers may only charge actual postage if mailed. These paper caps also apply to faxed copies and do not apply to workers’ compensation requests.
Beginning July 1, 2025, providers cannot charge copying or notary fees when the Tennessee Department of Health requests records for a complaint, inspection, or survey under §63-1-117.
Beginning July 1, 2025, if you ask for certified or notarized copies, providers may charge a flat $20. This applies to paper and electronic records. The fee only applies when you request certification or notarization.
Beginning July 1, 2025, non‑patient requesters pay a flat $90 for electronic records. Providers may require prepayment for requests other than a patient’s personal-use request. For Social Security disability denials or appeals, the electronic reproduction fee is $20 per request. Third‑party release vendors must follow these caps and cannot charge more.
Beginning July 1, 2025, records for workers’ compensation cases follow the fee rules in Tennessee Code § 50-6-204. The general caps in this law do not apply to those requests.
On July 1, 2025, subsection (d) of §68-11-304 is repealed. Current rules are those in this act and the remaining statute.
