Beginning January 1, 2026, Tennessee removes the standalone definitions of “disability certification” and “eligible individual” in the ABLE law. For program purposes, the eligible individual is the ABLE account owner and the designated beneficiary on that account. This tightens who counts as eligible and may affect what proof is needed to open or manage an ABLE account.
Money moved from a student's Individualized Education Account (IEA) into that student's ABLE account can be spent only on the student's education expenses. Spending must follow this part of state law and its rules. This restriction applies now and does not add new money or change taxes.
