Beginning July 1, 2026, for Tennessee property with 1–4 units and a mortgage lender, broker, or servicer, the settlement agency named on the buyer’s or borrower’s contract is the only one that can issue the title insurance. The lender, broker, or servicer can still use any approval rights. No party can waive or change this rule. This does not cover the first sale of new construction homes (including condos or single-family homes in developments with more than four units) or sales by auction.
Beginning July 1, 2026, if the buyer’s and seller’s title agencies agree to share title premiums, commissions, or other fees, they must give both sides written notice. The buyer and the seller must each sign a written acknowledgement. A title agency that did not issue the policy cannot take on liability for that policy. No agency is required to join a fee‑sharing arrangement.
