Employers must pay any wages owed at death to the surviving spouse, or if none, to the surviving children, or to a trust for them. Six months after death, if no one has applied to appoint a personal representative, anyone else who owes or holds the decedent’s money may pay up to $10,000 to the spouse or, if none, to the children, or to a trust for them. Any amount over $10,000 must go to the personal representative or as the court orders. These payments count against the decedent’s elective share, homestead allowance, and year’s support. If a recipient is a minor, the money goes to the child’s guardian or custodian.
