Schools are encouraged to keep bronchodilator rescue inhalers in at least two places. If a school chooses to stock them, they must be kept secure, unlocked, easy to reach, and used under a prescriber’s standing protocol. A school nurse or trained staff may give the inhaler to a student in distress under the protocol. Nurses, trained staff, and districts are protected from civil damages for ordinary negligence when they act in good faith during a life‑threatening event. The State Board of Education, with the Health Department, must set clinical protocols by rule. Rulemaking takes effect upon becoming law; all other parts take effect July 1, 2026.
Beginning July 1, 2026, licensed prescribers can write bronchodilator inhaler prescriptions to an authorized entity. Pharmacists can dispense the inhaler to the entity. A designated employee may give the inhaler in an emergency when a doctor is not available, following the standing protocol. If an entity chooses to stock an inhaler, it must name a responsible employee and keep it in an unlocked, secure, and accessible spot. Examples include child care centers, camps, restaurants, and sports venues. Employees, entities, prescribers, and pharmacists who follow the law are protected from civil liability unless they act with intentional disregard for safety. The Board of Pharmacy may set rules, and that rulemaking authority takes effect upon becoming law.
