Any ordinance under this law must follow the federal Fair Housing Act and the Americans with Disabilities Act. The local government cannot pass rules that discriminate against people seeking housing or people with disabilities. This protects access to sober living homes.
This law applies only in the county (and its cities) with a 2020 population between 366,200 and 366,300. The local government can require sober living homes within 1,000 feet of a K–12 school, preschool, or daycare to be certified by an approved group on the state mental health agency’s list. Homes already open before the law took effect are exempt from this distance rule until they close. The local government can also set siting and operating rules and make homes follow zoning and health, safety, fire, and building codes. It can require a licensed healthcare provider or a court to recommend a person before the operator lets them move in.
