Beginning July 1, 2025, after a court orders abatement of a nuisance, one more same-type incident on the same parcel is enough to presume the nuisance continues. If the court finds the same person or business kept the nuisance, it can award statutory damages of $1,000 to $50,000. If you own real property in the same ZIP code and file a claim for lost value from the continued nuisance, you can receive this money.
Beginning July 1, 2025, certain licensed or approved healthcare and treatment sites are excluded from the new nuisance presumption. This includes providers licensed under state health laws (Titles 33, 63, and 68), alcohol and drug treatment and recovery residences, licensed DUI schools, facilities licensed or certified by the mental health or health departments (including certified recovery courts), facilities licensed by the health facilities commission, facilities approved by the education department, and Department of Correction treatment programs.
Beginning July 1, 2025, repeat crime at the same parcel can create a presumption that a nuisance exists. For sex, drug, assaultive, or firearm incidents: three or more unrelated incidents in 24 months, then after written notice to the owner, another unrelated incident of the same type within 24 months of the first incident triggers the presumption. For property or juvenile incidents, the same pattern applies but over 36 months. A charge counts only if a warrant or citation was issued or a grand jury returned a true bill; for juveniles, a delinquency case must be filed. Authorized officials can then ask a court for remedies.
