The Attorney General can review county and city actions for violations of state law or the Tennessee Constitution. If a violation is found, the AG sends written notice naming the exact rule. The local government has 60 days to repeal or change the action and tell the AG, or to ask a three-judge court for a ruling. If it does nothing, the AG must file the case after 60 days. These rules apply to actions taken on or after July 1, 2025.
If a three-judge panel rules a local action illegal, it orders the state to withhold all funds to that local government, including grants and state-shared taxes. The Commissioner holds the money in reserve and releases it after the court accepts proof the violation is fixed. Funding then resumes, including state-shared revenues. The state cannot withhold funds in ways that break state contracts, federal law, court judgments, or the Tennessee Constitution. This applies to local actions on or after July 1, 2025, and to funds allocated during or after the 2026–2027 fiscal year.
