Backup posting when newspapers won’t publish

Beginning July 1, 2025, if a sale cannot be advertised in a newspaper, the officer must post the sale with a third‑party internet posting company. If a printer refuses to publish at the rates set in state law, the officer must use written posted notices and post the ad online instead.

Foreclosure ads now in print and online

Beginning July 1, 2025, a foreclosure sale ad must run in a county newspaper at least twice. It must also be posted online by a third‑party site for at least 20 straight days, and be viewable to the public. The first newspaper ad must appear at least 20 days before the sale. The written notice must list the website where the ad is posted.

Rules for postponing a foreclosure sale

Beginning July 1, 2025, a sale can be postponed without new newspaper ads if it happens within 1 year of the original date. Each delay must set a new date and time, be posted online, and be announced at the sale. If the delay is 5 days or less, the online announcement is not required. If the delay is over 30 days, the new date, time, and location must be mailed at least 10 days before the sale. "Location" means the physical sale place or, if online, the bidding website.

Simpler notice for debts under $200

Beginning July 1, 2025, if the debt is $200 or less, the owner can skip newspaper ads. The owner may use written posted notices and an online posting instead.

Stronger mailed notice to owners

Beginning July 1, 2025, the trustee must mail the sale notice to the debtor and any co‑debtor on or before the first publication date. Send it by registered or certified mail, return receipt requested. Mail it to the property’s address and to any other address the debtor gave in writing at least 30 days earlier. For a co‑debtor, mail to their last known or designated address if it is different from the property and debtor addresses and was given at least 30 days earlier.

Posting websites must register with state

Beginning July 1, 2025, third‑party sites that post foreclosure ads must give the state their root website address before doing this work, and report any changes. The secretary of state lists these companies and websites online. A company can be liable for damages if it fails to follow these rules.

Older mortgage contracts keep notice terms

Beginning July 1, 2025, notices that follow a prior mortgage, deed of trust, or other contract can keep those contract notice methods. This protects earlier agreements. But it also means some parties will not get the new dual newspaper‑and‑online rules.
