The law bars a constable from using law enforcement powers until they finish required in‑service education. Acting anyway is a Class C misdemeanor with a fine only. Each day you violate the rule counts as a separate offense.
Beginning July 1, 2025, newly elected or appointed constables must complete 128 hours of training approved by the Peace Officer Standards and Training (POST) commission within their first year. Until training is done, they must work paired with a trained constable or a POST‑certified officer. The pairing rule does not apply if they were elected or appointed within five years of serving as a full‑time POST‑certified officer. The 128‑hour training can be waived if they complete a comparable basic course within one year of election or appointment.
