Employees or agents of state or local health agencies who break this law face discipline, including possible job loss. An entity that gets state grants, state-run federal funds, or other state inducements can be fined the greater of three times the misused state resources or $50,000. The attorney general can also bar that entity from receiving grants or inducements for 1 to 10 years, based on the severity of the violation.
The commissioner and governor’s office must set an internal review to check messages against FDA labels by July 1, 2025. They must file a yearly compliance report starting January 15, 2026. The attorney general must set up a way to receive and investigate violation reports by July 1, 2025, and any person in Tennessee can report a suspected violation. After written notice of a violation, the entity has 10 days to stop the message and send a correction to the same audience. All covered groups must start removing noncompliant materials by July 1, 2025 and finish by January 15, 2026.
State health agencies and the governor’s office cannot share or fund messages about vaccines, masks, or emergency-use products that conflict with FDA labeling. They also cannot imply products are safe or effective to use together unless adequately powered, well-controlled trials support it. When a message talks about a product type in general, it must be true for all products in that group or clearly note the exceptions on specific labels. If state officials refer you to an outside source, the referral must say that source is not regulated by this law. The law still lets state leaders publicly criticize or disagree with FDA decisions.
