Beginning July 1, 2025, misdemeanor charges are retired two years after your arrest if you were found incompetent to stand trial. This applies only to charges that were still pending when you were found incompetent. The charges do not retire if you are restored to competency before that two-year date. If your charges are retired and you are released, the facility chief must notify the court and give the court and county sheriff an outpatient treatment plan that addresses community safety.
Beginning July 1, 2025, if you are charged with a misdemeanor and still hospitalized two years after your arrest, required reports to the court continue until you are discharged. This keeps the court informed during long hospital stays.
