Before deciding to list you, the prosecutor must send written notice to your current or last known work address. Your employer must deliver the notice to you at your last known address. The notice must say listing is being considered, give the reasons, and tell you how to respond. If you are listed, the office must send another notice explaining how to request reconsideration, deadlines, and what evidence to submit. You should file as soon as possible after you get the notice. If your reconsideration is granted, your name is removed; if denied or not filed correctly, it stays. The prosecutor may also remove your name any time if new facts support removal.
Brady lists and related files held by prosecutors are confidential and not open under the Tennessee Public Records Act. They can be shared with the officer or the officer’s lawyer, by law or court order, or with another law enforcement or prosecuting agency in another district. The law does not change prosecutors’ duty to disclose Brady material to defendants and courts. It also does not create a new private right to sue prosecutors or employers.
Any prosecutor that keeps a Brady list must have a written policy. Before adopting it, the office must share a draft with all law enforcement agencies in the district for comment. The policy must spell out placement criteria, written notice, a chance to respond, how to ask for reconsideration, and decision timelines. The law also defines what a “Brady list” is and which prosecuting offices these rules cover.
