Beginning July 1, 2025, a surety is not liable on the bond if the entering agency does not place the defendant on an available state or federal database within three business days of receiving the bench warrant or capias. This protects bail bond companies and individual sureties when agencies delay entering warrants.
Beginning July 1, 2025, courts and agencies must list certain no‑shows as fugitives in state and federal databases, including the National Crime Information Center (NCIC). This applies when someone misses court on a felony, on a violent or sexual Class A or B misdemeanor, or is charged with failure to appear. A judge must sign the bench warrant or capias by the end of the next business day. The clerk must send it to the entering agency by the end of the next business day after issuance, and that agency must enter it in the databases. If the person is held outside Tennessee in a place outside the limitation noted in the database entry, the district attorney has one business day after notice to decide whether to start extradition.
