If you are 18 or older, you may show your driving ability in a real road test while a Department of Safety employee rides with you. This applies to noncommercial vehicles under the state driving test rules.
Data from your digital license cannot be kept longer than needed and never more than 3 calendar days. It cannot be sold, and it can be shared only with police doing their job, a government agency allowed by state law, or by court subpoena. Contractors cannot capture or keep your biometrics, except a photo only to match your existing license photo for identity checks. The Department and contractors cannot capture or keep your device location. The law defines “biometric identifier” and “geolocation data” so these limits are clear.
The law clarifies what a Class D license lets you drive. It covers noncommercial vehicles that are not in Classes A, B, C, or M and not needing a special endorsement, unless that endorsement is listed on your license.
You can show a digital driver license to police, alcohol sellers, and others for ID. You cannot use a digital license to verify identity to vote; only a physical license is accepted. Using a digital license is optional, and no one can favor or punish you for using it. The Department and its contractors cannot charge a fee to participate. If your physical license is cancelled, revoked, or suspended, or you report your device lost or stolen, your digital license is disabled at once and must be removed within 20 days if the physical license is not restored. A state photo ID license gets the same digital protections, and the law standardizes terms to “digital.”
