Beginning July 1, 2025, the transportation commissioner can sign limited emergency contracts to fix road or bridge failures or hazards. The department can skip normal bidding, use alternative delivery, or choose a prequalified contractor to start work right away. Contracts must be narrowly tailored to the emergency. The usual cap of 28 alternative‑delivery contracts per year does not apply to emergency projects. Emergency projects do not need to be listed in the prior Transportation Improvement Program. Projects over $100 million also do not need that listing. The commissioner must immediately notify key legislative and fiscal leaders, and within 30 days file all bids and backup documents with the Fiscal Review Committee.
From July 1, 2025, TDOT tightens ethics and clarifies scoring for proposal reviews. Each selection‑committee member must sign an affidavit before reading proposals, confirming no improper contacts. The law updates wording: member scores are “compiled,” not “averaged,” and removes one prior committee rule. It also cleans up language on pre‑construction services contracts. Starting July 1, 2029, committees must use the scoring chart in the request for proposals, total and compile scores, and rank bidders from highest to lowest. Proposals go to the commissioner in rank order. The commissioner may accept the top‑ranked proposer or reject all and use another lawful method. Any written award notice must include each member’s scores for every proposal. Most changes start July 1, 2025; the ranking and award‑notice transparency steps start July 1, 2029.
