Beginning July 1, 2025, you can ask the Tennessee Secretary of State to fix a business filing under Title 48 or 61 that used your name or address without your consent. Your complaint must describe the document, give your contact details, list people involved and any known relationships, and include a statement under penalty of perjury; the Secretary may offer a form. If your complaint is incomplete, the office dismisses it within 10 business days and explains why. After review, if clear and convincing evidence shows misuse, the Secretary voids the business record. The office issues a decision within 30 business days of sending notice and then notifies parties within 7 business days. You and any responder can ask a court to review the decision, and you keep any other legal remedies.
Beginning July 1, 2025, when a compliant complaint is filed, the Secretary of State sends notice within 10 business days to all addresses and the email on file, with a copy and response instructions. You have 21 business days from when the notice is mailed and emailed to file a written response, signed under penalty of perjury. If no response is filed on time, the allegations are treated as admitted for this process. If a transaction is voided, the original filing fee is not refunded.
Beginning July 1, 2025, complaints and any responses in this process are public records kept by the Secretary of State. They are available to the public, which adds transparency but may expose private or reputational details.
