Property tax rules and late penalties

The city may tax the same kinds of property the state or county tax. The Board sets the rate per $100 of assessed value. If no new rate is set 90 days before taxes are due, last year’s rate stays in place. Late taxes add a 3% penalty for each month late, including on installments.

Better records, reports, and bond safety

The Board appoints a city recorder, who may also serve as treasurer. The recorder keeps city records and meeting minutes, issues privilege licenses, collects those license taxes, and collects ad valorem and special taxes. The treasurer gives full money reports at least every three months, or more often if the Board asks. All city bonds are kept by the recorder in a fireproof safe and are open to Board inspection.

Board sets key appointments and limits orders

When an alderman seat is vacant, the Board appoints the replacement. The Board appoints the city attorney and the city judge, and they serve at the Board’s pleasure. The judge must step aside if related within the third degree, has a personal interest, or believes they cannot be fair. The Board names an acting judge and sets pay by ordinance. Board members must not give orders to the mayor’s subordinates.

Law takes effect after local approval

These charter changes take local effect only after a two‑thirds vote of Erin’s legislative body. The presiding officer must announce the result and certify it to the Secretary of State. It is effective for the local approval vote when it becomes law; other parts take effect as stated in Section 37.

No self-dealing by city officials

City officials, certain board members, and employees may not profit from city contracts or deals. They also may not accept free or preferred services or benefits from people doing business with the city. State conflict-of-interest rules apply.

Nonresident owners can vote in Erin

You can vote if you live in Erin. Nonresidents can also vote if they own at least 50% fee simple interest in city property and show a certified deed or certified tax record. The Board is no longer the final judge of election results and qualifications. A short election deadline now runs 48 hours instead of 12.

Stricter rules to run and serve

To run for Mayor or Alderman, you must be a qualified voter, at least 18, and a U.S. and Tennessee citizen. You must have lived inside Erin for 24 months before the election. You are barred if convicted of bribery, larceny, or other infamous crimes unless restored, have unpaid official judgments or were a defaulter at election time, are in the regular armed forces, are in Congress or hold another office of profit or trust, or have not lived in Erin for two years. A seat becomes vacant if the official moves out of the city, is convicted of malfeasance, misfeasance, or a felony, or is removed under state ouster law.

Bank safeguards and small spending flexibility

The Board chooses official banks for city funds under state law and may require collateral to protect deposits. The threshold for unbudgeted spending that needs an ordinance rises from $2,500 to $5,000. The city no longer must use a single uniform pay plan for officers; pay can be set by ordinance without that rule.

Broader city powers on contracts and property

The city can contract and be contracted with. It may borrow and appropriate money to pay city debts and for municipal or state and national interests. The Board can appoint members to boards and commissions as allowed by law. The Board can sell city surplus property.
