Beginning July 1, 2026, a noncitizen age 18 or older with a final removal order commits a Class A misdemeanor by intentionally not leaving Tennessee within 90 days. The 90 days runs from the final removal order, or from the final court ruling if the person sought review. If federal appeals or other federal challenges are still open, the court must pause the state case until those end.
The law creates a Class A misdemeanor for a noncitizen age 18+ who was denied admission, excluded, deported, removed, or left while a removal order was outstanding, and then knowingly enters or tries to enter Tennessee. It does not apply if the U.S. Attorney General gave advance consent to reapply for admission, or if federal law did not require that consent. If federal challenges to the federal action are still open, the court must pause the state case. This crime takes effect 30 days after either the U.S. Supreme Court rolls back Arizona v. United States or Congress changes federal law to let states determine unlawful presence. The Tennessee Attorney General must give written notice of that start date.
