New jail intake rules for sick arrestees

Beginning July 1, 2026, jailers can refuse to book an arrestee who needs medical care and was arrested for a misdemeanor that is not a crime against a person under Title 39, Chapter 13. If a jailer refuses, the arresting agency must get the person evaluated by a healthcare provider. After the provider gives a written release saying the person no longer needs care or can be held in jail, the jailer must accept the person. The law also says other court order rules do not override this refusal, and it updates the general jail commitment rule to match.
