Beginning July 1, 2026, the law sets tougher penalties for unlawful disposal or discharge of sewage tied to septic work. These crimes are Class B misdemeanors when committed while working in a business that removes accumulated wastes from subsurface (septic) systems; otherwise they are Class C misdemeanors. After a conviction in that business context, the court must notify the state environment commissioner. The commissioner must suspend, refuse, or revoke the business permit: first conviction at least 30 days, second at least 90 days, third or later permanent. Permit actions use a summary process under state law and are in addition to other enforcement powers. These rules apply only to violations on or after July 1, 2026.
