The Tennessee Historical Commission and other state historic-preservation offices cannot regulate or punish work on certain properties. This applies to improved public or private property that is not on the Tennessee Register of Historic Places. It covers two cases: the commission considered but declined to list the property, or the property has not received any protection, grant, or other benefit tied to Register eligibility. These agencies cannot control renovation, alteration, or demolition of those properties or take adverse action against the owner. This does not apply to the State Building Commission, and it applies even if another state law says otherwise.
For properties described above, the Tennessee Historical Commission must finish reviewing all relevant information for any community development block grant within 15 business days after this law took effect. If the commission misses that deadline, the Joint Government Operations Committee requires the commission to appear and explain the delay. This speeds up decisions for those projects. It does not change who can get grants or how much money is available.
