35% of opioid funds to counties

The Opioid Abatement Council must follow a set split for statewide opioid settlements and bankruptcy funds. When these proceeds are deposited in the opioid abatement fund, 35% goes to counties that join the settlement, including counties described in subsections (q) and (s). The remaining 65% pays for statewide, regional, or local opioid abatement and remediation under section 33-11-105. A county must join the settlement to receive any of the 35% share.

Attorney General can release opioid claims

The Attorney General and Reporter can release state and local government claims tied to opioids. They must get written approval from the Governor and the Comptroller of the Treasury. The Attorney General may use this power only when it serves the state’s interest in resolving the opioid crisis. It covers many named companies and their affiliates, such as McKesson, Cardinal Health, AmerisourceBergen, Johnson & Johnson, CVS, Walgreens, Walmart, Kroger, Purdue, and others.
