Tougher release rules for violent felonies

Beginning July 1, 2026, people charged with a felony that used or showed a gun, or caused serious injury or death, are presumed not eligible for release on their own recognizance (without paying bail). If a judge or magistrate still releases the person, the bail order must include written findings on each factor the law lists for bail decisions. The law uses Tennessee’s standard definitions of “firearm” and “serious bodily injury.”
