Limits on using juvenile records in court

The law blocks using a child’s juvenile court disposition or hearing evidence against that person in non-juvenile courts, even after age 18. Judges and court staff can use a juvenile record in pretrial bond reports only if the adjudication was within the last five years. After a felony conviction, court staff may use juvenile records to prepare a presentence report. Use is also allowed in proceedings under §39-17-1352 and in prosecutions for violating the juvenile firearm purchase/possession ban in §37-1-190. Courts, probation staff, and the defendant’s lawyer may access the records only for these allowed purposes.
