Limits on suing police after evading arrest

The law shields Tennessee police from civil money damages for injuries or property damage caused while on duty. It applies when the person harmed was, at that time, engaged in conduct that later led to a conviction for evading arrest. It does not apply if the officer was grossly negligent or acted with willful misconduct. Bystanders and others not evading arrest can still sue for damages. This change is now in effect and does not affect criminal liability.
