Starting January 1, 2026, eligible Tennessee state employees get six workweeks of paid leave for a birth, adoption, or to care for a family member with a serious health condition. To qualify, you must be full-time for at least 12 straight months with a covered state entity; some attached boards or commissions are excluded. “Family member” means your child, spouse, parent, or a grandchild in your custody; a serious health condition can include hospice care. Give 30 days’ notice, or tell your appointing authority as soon as you can. This leave is on top of other state leave and counts as full-time work for service anniversary dates.
You can use at most six workweeks of this paid leave in any 12-month period, even with multiple qualifying events. You may take the time all at once or in parts, using intermittent or reduced schedules allowed under the federal Family and Medical Leave Act. For a birth or adoption, you must use the leave within 12 months of the event.
Starting January 1, 2026, if you were caring for a family member before that date and have unused time under the federal Family and Medical Leave Act (FMLA), you can use your remaining time as paid leave under this law. The paid time you get cannot be more than six workweeks. The Department of Human Resources can issue rules to clarify who counts as a family member and what a serious health condition means.
