Beginning July 1, 2025, a school employee trained in seizure safety and first aid is not personally liable for injuries from their actions or inaction, unless it is willful or wanton misconduct or gross negligence. Local school districts and public charter schools also are not liable for injuries from acts or omissions of such trained employees, unless the conduct is willful or wanton or grossly negligent.
Beginning July 1, 2025, each public and charter school must have at least one full-time employee trained each year in seizure safety and first aid. Training for volunteers who help give anti-seizure medicine counts if it includes seizure safety and first aid. This helps schools respond safely when a student or staff member has a seizure.
Beginning July 1, 2025, a school nurse employed by or under contract with an LEA or charter school is not counted as an "employee" under this law. School nurses do not receive this law’s liability protections.
