Tenants can keep lawful firearms at home

Beginning January 1, 2027, landlords cannot ban your lawful possession, carrying, transport, or storage of a firearm in your rented home. This also covers a firearm in your vehicle parked in tenant parking. The law protects you while crossing other landlord-controlled areas only as needed to enter or exit your home or parking. If a landlord violates this, you can sue for court orders, actual and punitive damages, and attorney fees. These rights apply to leases signed, amended, extended, or renewed on or after that date, and are subject to the law’s listed exceptions.

Landlord house rules must respect firearm rights

Beginning January 1, 2027, any landlord rules for the property must not conflict with the tenant firearm protections in state law. This applies to rules or regulations a landlord adopts or amends on or after that date.

No lawsuits for landlords who comply

Beginning January 1, 2027, a landlord does not face civil liability solely for following the law’s firearm rules. This protection applies only when a claim is based solely on compliance with the statute. It applies to leases on or after that date.

Places where tenant gun rights don't apply

Beginning January 1, 2027, these tenant firearm protections do not apply in some places. These include premises leased to a state agency; facilities tied to the mental health or children’s services departments; hospitals (including campus grounds); nursing homes, homes for the aged, adult care homes, assisted care living, or memory care; certain independent living units that open into an interior corridor serving those facilities; and school property covered by state law. These places follow their own rules. The limits apply to leases on or after that date.

Rules for carrying guns in common areas

Beginning January 1, 2027, a landlord may require you to keep a firearm concealed or holstered, or in a carrying container, when moving it between your car and home. The landlord may also require this in shared areas like hallways and elevators. If you do not follow those rules, the landlord can ask you to comply and use only lease remedies you both agreed to. Those remedies cannot ban lawful possession inside your unit. These terms apply to leases signed, amended, extended, or renewed on or after that date.
