Starting July 1, 2025, paid helpers must use a signed written agreement before doing any work. You only pay if your VA benefits go up, and the fee cannot be more than five times the monthly increase. They cannot charge upfront or nonrefundable fees, and no one can get paid for referrals. Helpers cannot promise a win or a certain rating. If you file within one year after leaving active duty, they cannot charge you unless you sign a waiver saying you know about free help.
Starting July 1, 2025, helpers must give you a clear written disclosure in at least 12-point font before you sign. You must sign it, and they must keep a copy during services and for one year after. They cannot process your data in call centers or data centers outside the U.S. They cannot use your login to reach your records. Anyone who sees your medical or financial data must pass ID and criminal background checks.
Violating these rules is a Tennessee Consumer Protection Act violation. Each day a violation continues counts as a separate violation. Penalty money goes to the state general fund. The act also lists these violations in the Consumer Protection Act. These enforcement rules apply to actions and agreements on or after July 1, 2025.
These rules do not apply to VA-accredited agents, attorneys, or representatives regulated by the VA. They also do not apply to Tennessee public or nonprofit colleges and their employees acting in their jobs. If you use those advisers, they follow VA rules or school policies, not this state law. This exemption applies to actions and agreements on or after July 1, 2025.
