Beginning July 1, 2025, two activities are exempt. Shipments that only pass through Tennessee in interstate commerce are allowed. Storing counterfeit or unsafe lighters in a Tennessee warehouse or distribution center is allowed if it is not open to the public for retail sale or distribution.
Beginning July 1, 2025, you cannot sell or give free samples of counterfeit lighters in Tennessee. A counterfeit lighter is one that violates someone’s intellectual property rights. The law also defines what counts as a lighter and what an “unsafe lighter” is, including ASTM F400-20 and F2201-20 standards. Breaking this rule is an unfair or deceptive act under Tennessee consumer protection law and is enforced under that law.
