If your bank gets a garnishment, it must check within two business days and place a hold on all available funds it holds for you. Within the same two days, the bank must mail or deliver you a copy of the garnishment summons and the Notice to Judgment Debtor. It must send the notice to your last known address in its records and also to the address on the creditor’s form if different. The bank cannot send the notice before it places the hold, and only the bank—not the creditor—may send it. When serving the bank, the sheriff or officer must give the bank the completed summons and notice forms.
If you make a warranty claim and send written notice by certified or registered mail or by courier, the warrantor has 30 days to pay. If the warrantor does not pay within 30 days after receiving your notice, you can recover reasonable attorney fees as part of your expenses. This also applies to drawees who pay an item and then send the required notice of a breach of warranty.
