Beginning July 1, 2025, when the wetland fund balance is over $6,000,000 during a month, the state may use it to maintain and improve state-owned lands run by the wildlife agency. When above this limit, the fund may also pay wildlife law enforcement salaries, benefits, and other necessary costs to carry out their duties.
Beginning July 1, 2025, the finance commissioner, with written approval from the wildlife agency’s executive director and subject to legislative appropriation, can transfer money from the wetland fund to the Tennessee Heritage Conservation Trust Fund. For state funding calculations, these transferred dollars do not count as “other available sources.”
Beginning July 1, 2025, the wetland fund cannot be used to buy any interest in real property by condemnation or eminent domain. The fund cannot pay for forced takings.
Beginning July 1, 2025, 3.25¢ of the realty transfer tax is credited to a special account called the 1986 wetland acquisition fund. Money in the fund does not expire at year end. Interest earned stays in the fund. Spending is used only to carry out the state’s wetland conservation program, aside from limited uses set elsewhere in law.
