Four-year limit on construction defect claims

Beginning July 1, 2025, you have four years to file a construction defect claim. The clock starts when the improvement is substantially complete. This covers lawsuits, arbitrations, and other binding dispute proceedings for property damage, personal injury, or wrongful death caused by design, planning, supervision, observation, or construction problems. It applies to claims against anyone who designed, supervised, or built the work. Claims under § 28-1-114(a) are not subject to this four-year limit. After four years, these claims are barred against those providers.
